New Canaan Man Arrested for DUI with Minors in Vehicle

A 49-year-old Deep Valley Road resident faces a felony charge for allegedly driving while over the legal alcohol limit with two minors in his vehicle.

According to police, Robert Avery was charged with risk of injury to a minor and driving under the influence.

Police received a report April 13 that an intoxicated man was driving with two youths in the car, said Lt. Vincent DeMaio of the .

Based on the caller’s descripton, police stopped Avery on Deep Valley Road after spotting him driving on Valley Road, DeMaio said.

He failed field sobriety tests and was arrested at 4:38 p.m., according to police.

Avery was released on $10,000 bond and scheduled to appear April 24 in state Superior Court in Norwalk.

An 18-year-old New Canaan man faces misdemeanor drug charges after he allegedly was found with marijuana and paraphernalia in an unoccupied home that’s up for sale and is owned by his parent or parents.

Joshua DeMarco was charged with possession of drug paraphernalia and cited for failure to halt possession of drugs by a minor, an infraction offense.

Police say that on the morning of April 15, a neighbor saw numerous beer bottles and cans in the driveway and front yard of the Ponus Ridge home and saw through a broken window a total of five adolescent males who appeared to be passed out in the house.

According to DeMaio, police found a smoking pipe and marijuana resident in plain view in the home, and saw that entry had been gained by breaking a window.

DeMarco must pay or plead by May 11, police said.

A 39-year-old Norwalk man was arrested by warrant at 6:50 p.m. on April 9 for allegedly stealing a credit card from a car parked in the New Canaan Y lot last year and using it.

Stephen Martin was charged with third-degree burglary, sixth-degree larceny, credit card theft and illegal use of a credit card, as well as conspiracy to commit each of those charges, DeMaio said.

Norwalk police picked up Martin on a separate offense and found that New Canaan held an active warrant for his arrest, stemming from the Oct. 10 burglary.

He was held on $5,000 bond and scheduled to appear April 10 in state Superior Court in Norwalk.

A 48-year-old New Canaan woman faces misdemeanor charges for allegedly slapping a minor on the afternoon of April 12.

Alicia Ezpeleta, of Trinity Pass Road, was charged at 2:49 p.m. with disorderly conduct and cited for possession of less than .5 ounces of marijuana.

According to police, an argument between Ezpeleta’s two daughters turned physical. When Ezpeleta became involved, she was called derogatory names and in turn, slapped the name-calling girl in the face, DeMaio said. When police arrived, one of the girls blurted out that her mother had drugs in her car, DeMaio said. The department’s K-9 unit detected the presence of marijuana in the car.

Police withheld the daughters’ names because of their ages. DeMaio said each was younger than 16. Each girl was charged with disorderly conduct and their cases were referred to the Juvenile Matters Division of state Superior Court in Norwalk.

Ezpeleta was released after promising to appear April 13.

Police say a piece of jewelry worth more than $5,000 was found in Walter Stewart’s on or around April 7, and anyone missing jewelry who may have lost it there should contact police.

A 36-year-old Darien man was arrested at 4:29 p.m. on April 9 and charged with third-degree assault and disorderly conduct.

Police said John Davis turned himself in on a warrant following a domestic dispute that resulted in minor injuries.

He was released on $2,500 bond and scheduled to appear April 12 in state Superior Court in Norwalk.
