New Canaan Man Charged with DUI in Darien

Stopped for not having headlights on at almost 1 a.m. Friday, the 51-year-old man was driving while intoxicated and had an electronic device to test for intoxication in his car, police said.

A 51-year-old man stopped near the intersection of the Post Road and Mansfield Avenue was driving while under the influence of alcohol, Darien police said.

Police gave this account (an accusation not proven in court) of the incident:

Michael Chen of New Canaan was driving on the Post Road without headlights on at about 12:54 a.m. when a Darien police lieutenant noticed the lack of headlights on the gray 2010  Nissan Acura MDX and started following it.

Chen immediately pulled into the parking lot behind Post Corner Pizza, which was closed, and the lieutenant approached the car. When talking with Chen, he noticed the odor of alcohol coming from him and asked him to do some field sobriety tests, which Chen failed.

Chen said he had just had two beers at Darien Social. Asked why he had pulled into the parking lot, Chen said it was because he noticed the patrol car following him.

Inside Chen's car, the lieutenant found a commercially available device to electronically check for alcohol intoxication, along with a cooler containing three cans of beer. The police report did not mention whether or not the beer was cold.

Chen, of Pastures Lane, was charged with driving while intoxicated and driving without headlights. He posted $250 bond and is scheduled to appear Nov. 18 in state Superior Court in Stamford.
