Representation for New Canaan Lieutenant Responds to Suspension

The following was received from Kevin M. Greco, representation for Lt. Frederick Pickering, whose suspension was announced early Tuesday. It is presented in its entirety: 

This shall respond to today’s New Canaan Police Department’s Press Release at 8:30 AM.  I and our Firm of Sandak Hennessey & Greco represent Lt. Frederick Pickering in Incident # 13-2268.

At the outset, we point out that this remains an employee personnel matter and as such, question the Department’s decision to unilaterally put out a press release prior to advising Lt. Pickering of the completion of the investigation and the Interim Chief’s decision, and prior to the completion of the appeals process. We intend to appeal the Interim Chief’s decision based on 1) substantive grounds, 2) numerous procedural irregularities in the investigation, and 3) the violations of Lt. Pickering’s contractual, employment, and due process rights.

We recognize that the Chief entirely cleared Lt. Pickering of any racial overtones. Consonant with the Chief’s decision, the internal investigation similarly concluded that the claims against Lt. Pickering of using racially offensive language were unfounded and did not occur. Based on the facts, we dispute the other findings in the Chief’s decision and believe that the recommended discipline is inappropriate.  

Since this is a pending matter, Lt. Pickering is not at liberty to discuss any specifics but wishes to thank the people of New Canaan for their out pouring of support. We look forward to the appeals process and a fair hearing before the State Labor Board.
